On January 13, 2014, the TRA announced it was opening a "show cause" proceeding against Tennessee Wastewater Systems, Inc., in a move that could lead to the revocation of Tennessee Wastewater's certificate to be the exclusive provider of wastewater services to a development known as the Villages of Norris Lake.
A case brought by Emerson Properties, LLC, to revoke the certificate of convenience and necessity ("CCN") of Tennessee Wastewater, led to a finding of a panel of TRA Directors in TRA Docket No. 13-00017 that Tennessee Wastewater is unwilling and incapable of effectively operating and/or managing the Villages of Norris Lake's system in compliance with TRA rules and Tennessee statutes. The TRA panel initiated a show cause hearing scheduled to be heard on February 3, 2014 at which Tennessee Wastewater must show cause why the TRA should not proceed to take action against Tennessee Wastewater for the unlawful actions and omissions alleged against it.
