Berry's Chapel Utility, #11-00005

Berry’s Chapel Utility, Inc., State’s Petition for Declaration That Berry’s Chapel Utility, Inc. is Subject to TRA Regulation, #11-00005

Berry’s Chapel Utility, Inc. notified the Tennessee Regulatory Authority that as of September 1, 2010, Lynnwood Utility Corporation, a wastewater disposal company operating in Williamson County, had been merged into Berry’s Chapel. It further contended that since Berry’s Chapel is a not for profit corporation, it is not considered as a “utility” under applicable law and thus the wastewater disposal operation is no longer subject to TRA regulation.

On January 10, 2011, The Tennessee Attorney General through the Consumer Advocate and Protection Division filed with the TRA a Petition for a Declaratory Order that Berry’s Chapel Utility, Inc. is a public utility under Tennessee law and that it should be regulated by the TRA.
